Terms and Conditions of Photography Services

Agreement to Terms

By booking a photography session with David LeClair Visuals, you agree to the following Terms and Conditions. These terms apply to all photography services provided, including commercial, event, portrait, and editorial photography.

1. Booking and Payment

• A non-refundable deposit of 30% is required to secure your booking.

• The remaining balance must be paid before or on the day of the session.

• Accepted payment methods include bank transfer, credit card, or other agreed-upon methods.

• If full payment is not received, the session may be canceled or rescheduled at the discretion of David LeClair Visuals.

2. Session Details

• Clients must provide accurate details about the location, subject, and scope of the session.

• Any schedule or location changes must be communicated at least 48 hours in advance.

• Failure to provide sufficient details may result in an inability to accommodate the requested service.

3. Rescheduling and Cancellations

• Rescheduling requests must be made at least 72 hours in advance.

• Cancellations within 72 hours of the session result in forfeiture of the deposit.

• In the event of severe weather or emergencies, we will make every effort to reschedule without additional fees.

4. Image Ownership and Licensing

• David LeClair Visuals retains full ownership and copyright of all images taken.

• Clients receive a non-exclusive, non-transferable license to use the images for personal or commercial purposes as agreed.

• Any use outside of the agreed terms may require additional licensing fees.

5. Delivery of Photos

• Photos are delivered in digital format unless otherwise specified.

• Standard turnaround time is 2-4 weeks, depending on the nature of the session.

• Any unexpected delays will be communicated to the client.

6. Image Use and Copyright

• Clients may use images for personal, online, and marketing purposes unless otherwise agreed.

• David LeClair Visuals retains the right to use images for portfolio, marketing, and social media purposes.

• Clients may not alter or edit the images without prior consent from the photographer.

7. Client Conduct

• Clients and participants are expected to behave respectfully during sessions.

• Any disruptive or inappropriate behavior may result in the cancellation of the session without a refund.

• David LeClair Visuals reserves the right to refuse service to anyone at its discretion.

8. Liability

• David LeClair Visuals is not responsible for any injuries or damages that may occur during a session.

• Clients are responsible for the safety of all individuals involved in the shoot.

• We are not liable for third-party damages or losses related to the use of our services.

9. Model Release

• By booking a session, you grant permission for your images to be used for marketing, portfolio, and social media purposes.

• If you do not wish for your images to be used in this way, please inform us in writing before the session.

10. Delivery of Prints & Products

• Print orders are fulfilled through third-party vendors and are final sale once processed.

• We are not responsible for print production issues but will assist with vendor concerns.

• Any defects must be reported within 7 days of receiving your product.

• Print delivery times vary based on vendor fulfillment schedules.

11. Dispute Resolution

• Any disputes will first be addressed through informal negotiation.

• If no agreement is reached, disputes will be resolved through arbitration, following the laws of the province or country where the service was provided.

12. Amendments to Terms

• David LeClair Visuals reserves the right to update or amend these terms at any time.

• Clients will be notified of changes, and updated terms will apply to all future services.
